AP Exclusive: Video draws animal cruelty charges

SANTA ANA, Calif. (AP) ? Prosecutors have filed animal cruelty charges against the owner and seven employees at a Southern California livestock auction house after undercover video shot by an animal rights group showed workers kicking, hitting and tossing the animals as they were readied for sale.

The grainy video, obtained Tuesday by The Associated Press and shot by the Los Angeles-based group Mercy for Animals, shows workers at Ontario Livestock Sales in Ontario, Calif., kicking and stomping on pigs to get them to move through a narrow chute, hitting emus with a baton and slinging baby goats by the neck and hind legs. In one shot, two workers drag a sick sheep that can't walk by its ears and heave it into the back of a van.

Prosecutors have filed a total of 21 misdemeanor counts against the owner, Horacio Santorsola, and seven employees after conducting further investigation with the help of the Inland Valley Humane Society, said Reza Daghbandan, a prosecutor with the San Bernardino County district attorney's office.

The defendants, who are not in custody, have a July 20 court date and face a maximum of a year in county jail and a $1,000 fine if convicted, he said.

Santorsola, 73, said the case was exaggerated and he and his employees had done nothing wrong.

He has not been cited once in the 18 years he's owned the business, he said, and grabbing animals by their necks and legs is necessary because they are not tame.

"I think it's a bunch of crap," Santorsola said. "How are you going to pick them up? They don't have a leash. They run, believe me, they do run."

The video was taken earlier this year over a seven-week period by an undercover investigator using a buttonhole camera, said Matt Rice, director of investigations at Mercy for Animals.

Prosecutors relied on the help of veterinarians to determine which actions crossed the line into criminal behavior, Daghbandan said.

"This isn't the same standard of care as a house pet would get ... but we felt comfortable that these instances went too far," he said.

Animal handling experts who reviewed the footage called the treatment of the animals, which include emus, pigs, goats, sheep and cows, "brutally improper."

"If they were to do this to a companion animal like a dog or a cat, everyone would jump up in outrage," said Holly Cheever, a veterinarian and expert witness in animal cruelty cases who is also vice president of New York State Humane Association.

Cheever said in one shot, a cow appears to be suffering from a prolapsed uterus and is bleeding.

"Even food animals are supposed to be given proper care and protection from abuse and this is very clear cut abuse," she said. "The dragging of the downed animals, the tossing of the baby animals onto the floor, leaving them gasping and dying: It's hard to choose any one aspect because it's pretty unpleasant from beginning to end."

A website for Ontario Livestock Sales says the family-owned business 40 miles east of Los Angeles holds auctions every Tuesday and handles horses, cattle, goats, hogs and exotic animals. The facility, which was founded in 1936, sells 1,000 to 1,300 animals every week, according to its website.

Mercy for Animals has filmed at livestock facilities around the U.S., including footage at a poultry farm that last year led Target and McDonald's to drop their egg supplier after undercover footage showed hens packed into cramped cages, male chicks being tossed into plastic bags to suffocate and workers cutting off the tips of chicks' beaks.

Groundwater depletion in semiarid regions of Texas and California threatens US food security

ScienceDaily (May 28, 2012) ? The nation's food supply may be vulnerable to rapid groundwater depletion from irrigated agriculture, according to a new study by researchers at The University of Texas at Austin and elsewhere.

The study, which appears in the journal Proceedings of the National Academy of Sciences, paints the highest resolution picture yet of how groundwater depletion varies across space and time in California's Central Valley and the High Plains of the central U.S. Researchers hope this information will enable more sustainable use of water in these areas, although they think irrigated agriculture may be unsustainable in some parts.

"We're already seeing changes in both areas," said Bridget Scanlon, senior research scientist at The University of Texas at Austin's Bureau of Economic Geology and lead author of the study. "We're seeing decreases in rural populations in the High Plains. Increasing urbanization is replacing farms in the Central Valley. And during droughts some farmers are forced to fallow their land. These trends will only accelerate as water scarcity issues become more severe."

Three results of the new study are particularly striking: First, during the most recent drought in California's Central Valley, from 2006 to 2009, farmers in the south depleted enough groundwater to fill the nation's largest human-made reservoir, Lake Mead near Las Vegas -- a level of groundwater depletion that is unsustainable at current recharge rates.

Second, a third of the groundwater depletion in the High Plains occurs in just 4% of the land area. And third, the researchers project that if current trends continue some parts of the southern High Plains that currently support irrigated agriculture, mostly in the Texas Panhandle and western Kansas, will be unable to do so within a few decades.

California's Central Valley is sometimes called the nation's "fruit and vegetable basket." The High Plains, which run from northwest Texas to southern Wyoming and South Dakota, are sometimes called the country's "grain basket." Combined, these two regions produced agricultural products worth $56 billion in 2007, accounting for much of the nation's food production. They also account for half of all groundwater depletion in the U.S., mainly as a result of irrigating crops.

In the early 20th century, farmers in California's Central Valley began pumping groundwater to irrigate their crops. Over time, groundwater levels dropped as much as 400 feet in some places. From the 1930s to '70s, state and federal agencies built a system of dams, reservoirs and canals to transfer water from the relatively water-rich north to the very dry south. Since then, groundwater levels in some areas have risen as much as 300 feet. In the High Plains, farmers first began large-scale pumping of groundwater for crop irrigation in the 1930s and '40s; but irrigation greatly expanded in response to the 1950s drought. Since then, groundwater levels there have steadily declined, in some places more than 150 feet.

Scanlon and her colleagues at the U.S. Geological Survey and the Universit? de Rennes in France used water level records from thousands of wells, data from NASA's GRACE satellites, and computer models to study groundwater depletion in the two regions.

GRACE satellites monitor changes in Earth's gravity field which are controlled primarily by variations in water storage. Byron Tapley, director of the university's Center for Space Research, led the development of the GRACE satellites, which recently celebrated their 10th anniversary.

Scanlon and her colleagues suggested several ways to make irrigated agriculture in the Central Valley more sustainable: Replace flood irrigation systems (used on about half of crops) with more efficient sprinkle and drip systems and expand the practice of groundwater banking -- storing excess surface water in times of plenty in the same natural aquifers that supply groundwater for irrigation. Groundwater banks currently store 2 to 3 cubic kilometers of water in California, similar to or greater than storage capacities of many of the large surface water reservoirs in the state. Groundwater banks provide a valuable approach for evening out water supplies during climate extremes ranging from droughts to floods.

For various reasons, Scanlon and other experts don't think these or other engineering approaches will solve the problem in the High Plains. When groundwater levels drop too low to support irrigated farming in some areas, farmers there will be forced to switch from irrigated crops such as corn to non-irrigated crops such as sorghum, or to rangeland. The transition could be economically challenging because non-irrigated crops generate about half the yield of irrigated crops and are far more vulnerable to droughts.

"Basically irrigated agriculture in much of the southern High Plains is unsustainable," said Scanlon.

But in February, the DoJ closed its investigation, in part because Microsoft and Apple had promised to license many of their core wireless patents under reasonable terms to anyone who needed them.

But the new company ? Rockstar Consortium ? isn?t bound by the promises that its member companies made, according to Veschi. ?We are separate,? he says. ?That does not apply to us.?

Hundreds of migrant and domestic agriculture workers and community and labour allies will be attending the 10th Anniversary of the Agriculture Workers Alliance (AWA) Support Centre in Leamington, Ontario this weekend. Over the past decade, the Leamington AWA Support Centre has become an invaluable resource and friend to the thousands of migrant and domestic agriculture workers who work each season in the Leamington, Essex County and Chatham-Kent areas.

On Sunday, May 27 at 4p.m., the celebration begins at the AWA Support Centre at 14 Albert Street in downtown Leamington. The celebration includes an official anniversary welcoming reception and speakers, a community barbeque, a soccer tournament, festive live musical performances, and the unveiling of a new outdoor mural to honour and recognize the enormous contributions that migrant agriculture workers make to the Canadian community.

Founded in 2002, the Leamington AWA centre was the very first of what has now become a network of ten AWA centres across Canada; four of them in Ontario including Leamington, Simcoe, Virgil and Bradford, Ontario. Operated in association with UFCW Canada (United Food and Commercial Workers union), the centres and their multi-lingual staff assist tens of thousands of agriculture workers annually with compensation claims, scheduling, pay issues, referral to legal counsel, health and safety training, CPP claims, and many other issues including unfair treatment and unsafe housing and working conditions. Today, with more than 10,000 members across the country, the AWA is the largest and most comprehensive agriculture workers' organization in Canada.

California labor enforcement task force announces public hotline for ...

California?s Labor Enforcement Task Force (LETF), a multiple agency collaborative effort to combat the underground economy and improve the state?s business environment, has announced a public hotline, 855-297-5322, for California workers and employers to call in documented complaints or provide enforcement tips.

?This LETF Hotline is another step towards ensuring that workers and employers have somewhere to report unlawful work activities, or if they suspect that a business is skirting the law in an effort to get a leg up on competition,? said DIR Director Christine Baker. ?The hotline will be a valuable tool to gather information to bring into compliance those employers who treat workplace safety and wage and hour laws as a nuisance.?

The LETF was formed to:

  • Ensure California workers receive proper payment of wages and are provided a safe work environment;
  • Ensure California receives all employment taxes, fees, and penalties due from employers;
  • Eliminate unfair business competition by leveling the playing field; and
  • Make efficient use of state and federal resources in carrying out the mission of the Labor Enforcement Task Force.

LETF members include: DIR?s Division of Labor Standards Enforcement (Labor Commissioner) and Cal/OSHA, as well as the Employment Development Department, Board of Equalization, Alcohol and Beverage Control and the Bureau of Automotive Repair.

Businesses operating underground generally violate those laws that are designed to protect workers and California?s economy. Skirting income taxes, not carrying workers? compensation insurance, and paying employees less than what they are owed are common practices of underground businesses. These underground operations subsequently require lower overhead, giving an unfair advantage to the illegal businesses over legitimate, law-abiding employers.

California workers and employers can contact the LETF hotline at 855-297-5322. Complaints will be screened and prioritized in order to catch the most egregious offenders.

Last weekend, many of us here on the West Coast dabbled in a bit in astronomy during a partial eclipse of the sun. With the sun low on the horizon, I stole a quick glance to see if I could glimpse a shadow.

Yup, I did. And then I saw something else: stars. My eyes!

My advice: Do not try this at home. And definitely don't even think about it at around sunset ET on June 5, when the planet Venus will do something really unusual. It will dart across the sun, and much of the world will be able to watch it make its move with the right (and safe) equipment.

It's called the transit of Venus. The planet will appear as little dark circle on the sun as it zips between us and that big yellow ball.

If you want to catch it, hope for a clear sky because you won't see it again. About every 120 years or so, transits of Venus come in clusters ? two in eight years. The last one was in 2004, and we won't see another until well into the 22nd century. Astronomers long ago figured out when the transit of Venus would occur, and they discovered that timing it down to the second would give them tremendous insight into the solar system.

When the event occurred on June 3, 1769, scientists ? including the famous Captain James Cook ? fanned around the globe in an attempt to uncover the secrets of the universe.

In his new book The Day the World Discovered the Sun: An Extraordinary Story of Scientific Adventure and the Race to Track the Transit of Venus, author Mark Anderson uncovers the tales of the men who literally went to the ends of the earth in search of discovery.

In an interview, Anderson talked about the goals of the missions, the way 18th-century scientists managed to measure time to the second (hint: not with an iPhone stopwatch), and how clouds on the big date may be more than just a mood-buster.

Q: What was the big mystery that all these scientists were trying to solve?

A: In two words, it was "how far."

How far is the most important thing in our universe, the sun? And how far would you go to find that answer? Would you be willing to lay down your life? A host of scientists and explorers at this time did just that.

The other question is essential to the story: How far is the shore? That's the other question, the one that ship navigators could not answer. As a result, thousands of people died gruesome deaths at sea by shipwreck or being lost at sea.

These astronomers had invented an 18th-century GPS system that opened up the entire planet to seafaring nations. The voyages were the perfect testing grounds for this new technology.

The cool thing for the story is that to find the answer to both questions, you have to go to the ends of the earth. That sets the stage for an amazing adventure.

Microsoft beats Motorola in German SMS patent suit, litigation world cup continues

Munich's regional court has ruled that Motorola is infringing one of Microsoft's patents relating to displaying multiple SMS messages. It's one of the sub-cases that's separate to the larger FRAND matters that are raging along in the background, but still has enormous ramifications. Redmond's deputy general counsel, David Howard said that he hoped Motorola would (join over 70 percent of all Android OEMs) license Microsoft's patent portfolio. If Google's latest plaything doesn't start writing cheques, then it's likely to have its handsets banned from Germany, at least in the short term.

Analysis: How Egypt's elections can transform the Mideast

CAIRO -- The upcoming Egyptian elections have the potential to not only change Egypt, but the entire Middle East.?There?s a strong possibility that decades of American policy in the region can be overturned. ?The elections have huge implications for the United States and even bigger ones for Israel.? War and peace may be in the balance.?

Here in our Cairo bureau as I listen to the boats float by on the Nile blasting music as revelers enjoy the city before it?s clogged by voting with checkpoints, there?s talk that this could be a moment like 1979 in Iran, a possible 180-degree shift for the country and the Middle East.? I?ll start at what?s immediately coming up.

On Wednesday and Thursday, Egyptians go to polls to elect a new president.? First off, that?s big statement in itself.? Egypt hasn?t elected a truly democratic leader in its 5,000 years of recorded history. ?This is the land of the pharaohs, the undisputed and often tyrannical God-kings.? Then it was the land of the Romans, sultans, Mamluks, Khedives, kings, European-dominated governments and finally military rulers.?

There are five main candidates who have a chance of winning the election.? Egypt has a presidential system.? The president runs the state.? Who the president is matters profoundly.? In no particular order, the candidates are:

?Mohammed Musri: Mursi is a leading member of the Muslim Brotherhood.? The Muslim Brotherhood, or the Brotherhood for short, is an Islamic group founded in Egypt in 1928.? It has been pursuing a secret campaign to take over the government since its creation.? The Brotherhood wants a state that is modern, powerful, technologically advanced and Islamic.? The Brotherhood is not the Taliban.? It does not want to ban music and pull girls from school, but it does believe that Islam must be the core of politics and society.? The Brotherhood?s slogan has long been ?Islam is the solution.?? In practice that means, if there?s poverty, the Brotherhood will look to Islamic principles of helping the poor to solve them.? The Muslim Prophet Mohammed was a big believer in charity and firmly established helping those in need as a basis of the religion. If there?s disease, the Brotherhood sees Islam and its traditions as having a solution to that too.? In questions of war and peace, the Brotherhood will study Islam and its history to determine if a potential conflict is just and warranted.? For the Brotherhood, Islam is always the solution.? It?s Islam uber alles.? The Brotherhood is a politically astute group.? It is calculating and slow moving, believing that the best way to gain power is by gradually winning political and social influence.? The Brotherhood is the grandfather of nearly all Islamic movements.? It is the mothership from which smaller, often more radical groups were born.? Hamas in Gaza, for example, is a faction of the Brotherhood.?? The Brotherhood is also rich.? Its finances are murky and secretive.? The group has wealthy donors, especially in the Sunni Arab Gulf states.?

According to some estimates, the Brotherhood has a million activists in Egypt.? Mursi is the official brotherhood candidate, but would likely end up as the group?s ?face man.?? Mursi is not charismatic.? He?s not a dynamic speaker.? He wasn?t the Brotherhood?s first choice.? The group initially wanted its powerful money man Khairat al-Shater, a business tycoon who manages the group?s wealth, to be its candidate, but he was disqualified on account of his prison record.? Egypt?s military-backed presidents, including Hosni Mubarak, imprisoned many Brotherhood members, seeing the group as its biggest existential threat.? Analysts say Shater, the Brotherhood?s supreme guide, and its leadership committee would end up being the real force behind Mursi, pulling the strings.?Right after the revolution that toppled Mubarak, the Brotherhood said it would not present a candidate for president, but then broke its promise.? A Brotherhood victory would be a total about-face for Egypt.? Since the late president Anwar Sadat, Egypt has pursued a largely pro-American, Western-leaning policy.? Egypt has maintained a peace treaty with Israel since March 1979, following the Camp David accords.? The Brotherhood has already threatened to cancel the peace treaty if the United States stops providing the $2.1 billion of military and development aid Egypt has received annually since 1982.? The Brotherhood now talks publicly about maintaining good relations with the United States, but at its core the group is not pro-American.? The Brotherhood is actively anti-Israel.? Egypt?s long-term relations with United States and short-term relations with Israel could be at risk if Mursi becomes president.? Egypt is the biggest country in the Middle East.? So goes Egypt, so goes the region.? A dramatic shift in Egypt?s alignment would have global implications.

Abdel Monein Abu al-Fotouh.? Al-Fotouh was a member of the Muslm Brotherhood for decades.? He?s a devoted Islamist.? In fact, he was once of member of the even more radical Gamaa Islamiya (Islamic Group), the same organization of Sheikh Omar Abdel Rahman, the blind cleric imprisoned in the United States for masterminding the first attack on New York?s World Trade Center in 1993.? Al-Fotouh left the Gamaa Islamiya for the Brotherhood.? He then broke from the Brotherhood after the Tahrir Square revolution.? The Brotherhood promised at the time not to run a presidential candidate.? Al-Fotouh disagreed and launched his own campaign.? His disobedience to the Brotherhood?s orders infuriated group?s tightly controlled hierarchy and Al-Fotouh was expelled from the Brotherhood.? Since the revolution, Al-Fotouh has been trying to appeal to Egypt?s liberals and secularists.? He says he?s still a member of the Brotherhood at heart, but wants a state where religion doesn?t drive all policy.? It?s possible Al-Fotouh has a change of heart.? Many of the Tahrir Square revolutionaries are taking al-Fotouh at his word.? But is he really different, or just changing his tune to appeal to a broader base??? Al-Fotouh, like Mursi, speaks about maintaining good relations with world powers, including the United States.? During his campaign, however, Al-Fotouh called Israel ?an enemy state.?? Al-Fotouh is also now backed by hardline Islamists known as Salafists who want to live in a society modeled on the life of the Prophet Mohammed in the 7th century.? The Salafists ? many of them still followers of al-Fotouh?s old group, the Gamaa Islamiya -- ?want to roll back rights for woman and Christians.?Critics say al-Fotouh is trying to be a candidate for everyone, telling revolutionaries and secularists he?s become one of them, while also appealing hardcore Islamists. He has tried to appeal to Christians and women by promising that he will consider appointing one of them vice president should he win. A victory for al-Fotouh would be a win for Islamists.? Is he still member of the Muslim brotherhood in disguise?? Would he make peace with the Brotherhood and return to their fold if he became president?? Al-Fotouh likes to say Turkey is example Egypt could follow with an Islamist leader, but without Islamic fundamentalists deciding how people should live their daily lives.? Critics say its sounds good, but that Egyptian Islamists are much more radical than their Turkish counterparts and that it?s hard to imagine that after decades as a dedicated member of the Brotherhood that al-Fotouh could really have changed fundamentally.? The questions about al-Fotouh?s true beliefs are unlikely to become clear unless he wins the election.?

Amer Moussa:?Moussa is the 76-year-old former Egyptian foreign minister and secretary general of the Cairo-based Arab League.? He is a seasoned and internationally respected statesman.? He?s well known and generally popular in Washington.? Moussa is presenting himself as a steady hand, the candidate who can maintain Egypt?s international relations and not drive the country into isolation or deep into the fold of the Muslim world.? Moussa has said publicly he has no intention of changing or eradicating the Camp David accords with Israel.? He is dedicated to close ties with the United States.? Moussa?s main problem is his association with the former Mubarak regime.? Even though he wasn?t involved in the crackdown and killing of activists during the revolution, he was a key Mubarak associate for decades.? Critics call Moussa part of the ?fulool,? a word that means ?remnants.?? It is a disparaging term.? It is almost like rubbish or trash.? Critics say Moussa is just another fulool of the Mubarak regime that the revolution swept away.? Moussa?s biggest rivals are the Islamic candidates Mursi and al-Fotouh.? Moussa?s Islamist opponents have tried to depict him as a drinker who is close to Israel and the United States.? Moussa believes Egypt is at a crossroads and that voters can pick him to promote stability or Islamists to change the country?s course?in a precarious new direction.

Ahmed Shafiq:?Shafiq is the ultimate ?fulool? candidate.? He was the last prime minister appointed by Mubarak.? Shafiq was, like Mubarak, an air force commander.? Shafiq still defends Mubarak.? Shafiq is presenting himself as ?Mr. Security.?? After the revolution Egyptian police were discredited.? They were seen as the henchmen of the Mubarak regime.? For the past year, the police have largely been absent from the streets.? With the police gone, murder, rape, kidnappings, car-jackings and antiquities? theft have all risen dramatically.? Shafiq says he?ll restore order in 24 hours.? He?s the strongman candidate.? His message appeals to some Egyptians fed up with the deteriorating security situation.? Critics say the revolution replaced one dictator in Mubarak and that electing Shafiq would simply be bringing in another one.

Hamdeen Sabahi.? Hamdeen Sabahi is popularist.? He appeals to the country?s poor.? Economically, Sabahi is a socialist who sees Egypt?s greatest strength as its legions of rural and urban poor.? Politically, Sabahi is a Nasserist, or a follower of the tradition of the late Egyptian president Gamal Abdel Nasser.? Nasser was a champion of Arab unity and a believer in pan-Arab power.? Nasser firmly believed that if Arabs were to unite, they could become a powerful economic and political bloc that could break free of a Middle East many Egyptians see as dominated by American and Israeli interests.? Nasser was no friend of the United States.? He aligned Egypt with the communist Soviet Union and launched a failed war against Israel.? When Nasser died, his successor Anwar Sadat re-orientated Egypt?s economic and politics policies by building close ties with Washington and forging a peace treaty with Israel.? Sabahi?s victory could mean that Egypt?s four-decade-long Western orientation would shift again, reverting to a populist form of pan-Arabism.?? Sabahi has had a recent surge in popularity and was recently supported by 400 famous Egyptian actors, artists, writers and journalists.

On the first anniversary of the uprising that toppled Hosni Mubarak's regime, hundreds of thousands poured into the revolution's symbolic center, Cairo's Tahrir Square. NBC's Ayman Mohyeldin reports.

The likely outcome
What?s likely to happen?? None of the five candidates are likely to win an outright majority when voting closes at 8 p.m. Cairo time on Thursday evening.? To win, a candidate needs more than 50 percent of the votes. ?It?s widely expected, however, that each of the five leading candidates will win between 10 to 30 percent of the vote.? Mursi for example could win 20-25 percent, Moussa might take another 20 percent, Al-Fotouh perhaps 20 percent and so on.? Since none of the candidates would have the more than the fifty percent needed for a victory, there would be a run-off.?

The run-off would work as follows:? The two candidates with the highest number of votes -- say Mursi with 25 percent and perhaps Moussa or al-Fotouh or Sabahi with another 20 percent or so ? would face each other.? The run-off election would take place on June 16-17.? The winner of the runoff would become Egypt?s next president, starting his four-year term starting on June 30.? Once the new president assumes office, the military council ? the leadership committee of generals that has been administering Egypt since the revolution ? would dissolve.? Egypt?s first democratically elected president in its history would then run the country and its powerful, US-armed military.

Who?s winning?
Opinion polls have been all over the map.? Many polls put Moussa ahead.? The Brotherhood says Mursi is in the lead.? The polls do not seem reliable.? Political analysts I?ve spoken to believe Mursi, even though he?s uncharismatic, is likely to win enough votes to secure a place in the run-off.? After all, the Brotherhood has a million activists get out the vote, a grassroots support base that?s unmatched by any other candidate.? The run-off, according to some analysts, would therefore be between the Brotherhood?s Mursi and someone else.? It?s anyone?s guess who that someone else might be.? That?s when Egyptians? will have to make an incredibly important choice.? Assuming Mursi is a candidate in the run-off, analysts say the tale of the tape might be like this.

If the run off is between the Brotherhood?s Mursi vs Amer Moussa or Ahmed Shafiq, analysts predict Mursi would win.? Moussa and Shafiq would simply be too ?fulool,? not different enough from Mubarak.? It?s possible, however, the voters could have a change of heart and vote for the promise of stability over the certainty of change.? It?s very hard to predict.?

If the match up, however, is Mursi vs al-Fotouh or Sabahi, analysts say it?s likely Mursi would lose.? The Brotherhood already controls parliament and voters might fear giving the long-banned group too much power.? Again, no one really knows.? What?s certain is that this is a critical time for Egypt, the Arab world, Israel and the United States.? Egypt is at a crossroads.? The path Egyptians chose is important.? Egypt is the most populous Arab nation, the seat of Sunni Islamic doctrine and has tremendous political, religious and social influence on the rest of the region.? For better or worse, it will lead the rest of the Middle East by example.? So goes Egypt, so goes the region.

Pacers, Heat respond to Bird's 'soft' comment

(AP) ? Larry Bird called the Indiana Pacers soft. His team agreed. LeBron James thought otherwise.

Bird told The Indianapolis Star early Wednesday that he "can't believe my team went soft" after the Pacers were beaten 115-83 in Game 5 of an Eastern Conference semifinal series Tuesday night against the Miami Heat.

Miami leads the series 3-2, with Game 6 on Thursday in Indianapolis.

Tuesday's game in Miami was marred by three flagrant fouls ? one committed by Indiana's Tyler Hansbrough against Dwyane Wade, another by Miami's Udonis Haslem against Hansbrough moments after Wade was bloodied. The last was a particularly hard play by Heat reserve center Dexter Pittman against the Pacers' Lance Stephenson in the final seconds.

"I agree with his assessment. We did play soft," Indiana's Danny Granger said Wednesday. "We got smacked around. We got beat up, we got bullied, and we really didn't respond well.

"I've been with Larry since I've been in Indiana for seven years," Granger added. "He's not been one to hold his tongue, and 99 percent of the time what he's saying is right. I think he just called out what everyone else saw. We played a soft game. We didn't play with the playoff intensity that we needed to win."

Granger was in flip-flops when Wednesday's practice ended, saying the left ankle he sprained in Game 5 was still painful. Stephenson, who had X-rays taken to rule out any fractures to his collarbone or shoulder areas, did not practice.

"In my mind, I'm going to play," Granger said. "Elimination game, I have to play."

Vogel sounded concerned, but optimistic.

"Very much hoping he'll be available tomorrow," Vogel said. "He's a gamer. I'm thinking he'll play. But his ankle's pretty bad, so we'll see."

The Heat had a different reaction to Bird's comments. With the Pacers facing a win-or-else game Thursday, James thought Bird ? recently announced as the league's executive of the year ? wanted to provide extra incentive for Indiana.

"He's just trying to amp them up. That's all. That's all it is," James said. "He knows his team isn't soft. But with them, with their backs against the wall at this point, he knows what he's doing. He's not the executive of the year for no reason."

All three of the flagrant fouls called Tuesday were category-1, meaning no players were automatically ejected. The league has a wide range of options available for its review process, including upgrading those fouls to category-2. The NBA could also issue fines and suspensions.

"I expect they will. That game was nationally televised," Granger said. "A lot of people saw the plays. I think they have to."

The NBA had made no public comment before either team finished practices Wednesday.

"All the chatter and all the stuff, it'll still end up being decided between the lines," Heat coach Erik Spoelstra said. "And it'll be decided by the rules of the game."

Wade sounded somewhat amused that Granger ? who's been whistled for three technicals in the series ? was one of the Pacers suggesting Haslem and Pittman should be suspended. Wade and Granger have had words during the series.

"We're not in here crying about the fouls," Wade said. "They fouled us. ... We're moving on to Game 6. We're not going to worry about what happened in Game 5. For us, it's about moving forward."

There were a number of other hard fouls in Game 5 that were not considered flagrant but continued the trend of what's become a physical series. Indiana forward David West ? who left Tuesday's game with what the team called a sprained knee, though he insisted Wednesday he was not hurt ? took exception to a play where he was knocked backward, saying a Heat player fell into his knee.

Not long afterward, he fouled James, who said he saw it coming.

"He was the one on the floor and I was the one still standing," James said. "So I started laughing at that. But he tried to get me."

Indiana coach Frank Vogel called Miami floppers before the series started, and it's been gritty throughout. The teams combined to shoot 66 free throws in Game 1, and there have been a combined nine technicals and flagrants called in the four games since. Other dustups included Stephenson making a choke sign that television cameras caught during Game 3, and Juwan Howard confronting him about his antics before Game 4.

"It's been a physical series, started by them," Wade said.

The Pacers practiced in Miami before flying home Wednesday, a somewhat uncommon move but one that Vogel wanted in an effort to keep his team on a relatively normal sleep schedule.
